The Service is provided "as is" to the extent permitted by law. Speed, latency and continuous availability vary depending on the user's network, providers, selected route, device and third party software.

SmFrendly provides access to its own network infrastructure, but does not guarantee the availability of a particular site, application or content. Incy is a separate third party application; SmFrendly is not its developer and is not responsible for the operation of application stores and updates to Incy.

The user is independently responsible for his actions, the safety of his personal link and compliance with the law. Access may be temporarily limited in the event of a security threat, abuse, lack of payment, or at the legal request of an authorized body.

These conditions do not exclude or limit consumer rights that cannot be limited by agreement under the laws of the Russian Federation.

1. General provisions. These terms and conditions govern the provision and use of the SmFrendly service.

2. Subject. The Contractor provides the user with the technical ability to temporarily access the network infrastructure through a personal configuration. The route composition, tariff and charge-off rules are shown in the interface before use.

3. Acceptance. The combination of these conditions and the payment offer addressed to the user is an offer. Payment is considered full acceptance after reading the terms and conditions and price in rubles. Free bonuses in and of themselves do not create an obligation to pay.

4. Calculations. “vpn” is an internal unit of account of the service, which is not a currency, electronic money or security. It is used only to account for the paid volume of services and bonuses, is not exchanged for cash and is not transferred between users, except for the directly specified referral program.

5. Issue, bonus, reserve and write-offs. The first 10 links in a user's history are issued free of charge, each subsequent one for 1 vpn; No more than 10 links can exist at a time. There are no write-offs until the first incoming byte. The first byte, in one atomic operation, accrues the bonus due to the link, blocks up to BT × 168 hours and writes off the current astronomical hour. If there is a deficiency, the entire free balance is blocked; repeated partial blocking earlier than 168 hours is prohibited. When deleted, the remainder of the reserve and the unused bonus of this particular link are burned.

6. Term and Termination. The Agreement is valid from acceptance until the paid volume is exhausted, use is terminated or blocked on a legal basis. The user has the right to refuse the service by deleting the links and contacting support. Refunds and recalculations are considered upon application, taking into account the actual service provided, expenses incurred and mandatory norms of the legislation of the Russian Federation.

7. Changes and disputes. The new revision applies to future actions after publication. The law of the Russian Federation applies to the agreement; the claim is first sent through support, without limiting the right to appeal to an authorized body or court.

Operator and goals. The operator of personal data is the performer. Data is processed for logging in via Telegram, execution of a contract, accounting for services and bonuses, support, protection against abuse, auditing and fulfillment of legal obligations.

Data composition. Telegram ID, name and username; account status; link and device information, including the encrypted Incy identifier; aggregated traffic volumes and speeds; balance, accruals and write-offs; referral connections; support requests; security events and technical logs.

Network information. The service does not generate a history of visited resources and does not save the content of user traffic in the accounting database. The public network address may be briefly processed for connection and anti-sharing purposes; Only cryptographic attributes and aggregated events without a source address are transferred to persistent storage.

Storage. Detailed second traffic data is stored for up to 2 days, minute summaries for up to 90 days, hourly summaries for up to 2 years. Accounting, contractual, audit data and requests are stored as long as necessary for the provision of services, settlements, protection of the rights of the parties and compliance with the law, after which they are deleted or anonymized.

Transmission and overseas routes. Data may only be processed by hosting and network infrastructure providers to the extent necessary. Telegram and Incy are independent third-party services. By choosing a foreign route, the user initiates the passage of network traffic through infrastructure outside the Russian Federation; The main accounting base of the service is located in the Russian Federation.

Protection. HTTPS, access control, encryption of sensitive identifiers and configurations, activity logging and backup are used. Marketing trackers and cookies are not used; an incomplete action can only be temporarily stored in the current WebView session.

User rights. Through support, you can request information about processing, clarification, blocking or deletion of data, withdraw consent where processing is based on consent, and also submit a complaint. Mandatory contractual and legal data may be retained after such a request to the extent required by law.
